Terms of Sale & End-User Licence Agreement

These terms govern your purchase and use of Lull (“the App”), a native macOS application sold by Alex Halchenko (“we”, “us”), the operator of lull-player.co.uk. By buying or using the App you agree to these terms. If you do not agree, do not use the App; if you have already bought it, you can request a full refund within 30 days (see Refunds).

Your purchase is completed through Paddle, our authorised reseller and Merchant of Record. Paddle handles payment, billing, and sales tax, and its Buyer Terms and Privacy Notice also apply to the transaction itself.

1. What Lull is

Lull is a media player. It plays audio from sources you provide to it: podcast feeds, internet-radio and audio streams, local files on your Mac, and links you paste. Lull does not host, store, sell, or distribute any audio or video content. It plays what you point it at, on your own device.

Your purchase grants a perpetual licence to use the App on the Macs you personally use (a soft limit of three devices). It includes 12 months of updates. After that, an optional annual renewal continues updates: new sources, features, and maintenance. If you do not renew, the App keeps working; it simply stops receiving new updates. We never disable software you have paid for.

Your licence key is verified on your device; it does not require an account or an internet connection.

4. Third parties and trademarks

Lull is an independent product and is not affiliated with, sponsored by, or endorsed by any third-party service, website, or content provider it can play from. All product names, logos, and trademarks belong to their respective owners and are used for identification only. YouTube is a trademark of Google LLC; Lull is not affiliated with or endorsed by Google or YouTube.

5. Reliability

Some sources change how they work from time to time, and playback from a particular source can occasionally break. This is true of every tool in this category. We aim to ship fixes promptly, and podcasts, internet radio, and your local files do not depend on any single source and keep playing. We do not guarantee uninterrupted playback from any particular website or service.

6. Open-source components

The App uses open-source software, including libmpv (dynamically linked, under the LGPL) for audio playback. The component used to resolve certain links is not bundled inside the App; it is obtained and updated from its upstream source at runtime. Open-source licences and notices are available on request.

7. No warranty and liability

The App is provided “as is”, without warranties of any kind to the extent permitted by law. To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss arising from your use of the App with content you were not entitled to use. Nothing in these terms limits your non-excludable statutory rights as a consumer (for example under the UK Consumer Rights Act 2015 or your local equivalent), or excludes liability that cannot lawfully be excluded.

8. Refunds and termination

Purchases are covered by a 30-day money-back guarantee (see Refunds). We may terminate this licence if you materially breach these terms; you may stop using the App at any time.

9. Changes and governing law

We may update these terms; the version in force at the time of your purchase governs that purchase. These terms are governed by the laws of England & Wales, whose courts have non-exclusive jurisdiction.
